These Terms of Service (“Terms”) govern your use of the MyListerHub platform and services, operated by MyListerHub Inc. (“we,” “us,” or “our”). By registering for an account, accessing our platform, or using any portion of our services, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the platform.

These Terms apply to all users of the platform, including individual sellers, business users, agencies, and anyone accessing the site or its tools.

ACCOUNT & ELIGIBILITY

To use MyListerHub, you must meet the following requirements:

  • Minimum Age Requirement: You must be 18 years of age or older. If you are under 18, you are not permitted to use the platform under any circumstances.
  • Accurate Information: You must provide truthful, complete, and up-to-date registration information when creating your account, including your name, business details (if applicable), email address, and payment method.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and restricting access to your account. Any actions taken under your account are your responsibility. If you believe your account has been compromised, notify us immediately at [email protected].
  • Account Ownership: The individual or entity whose payment method is associated with the account is considered the “Account Owner” and is ultimately responsible for the account.

We reserve the right to suspend or terminate accounts if we suspect false information, unauthorized use, or a breach of these Terms.

SERVICE DESCRIPTION

MyListerHub is a subscription-based SaaS platform designed to help e-commerce sellers manage, optimize, and automate their online sales operations across supported marketplaces.

Our platform includes, but is not limited to, the following features:

  • Listing Management: Tools to create, relist, schedule, and manage product listings across platforms (e.g., eBay).
  • Inventory & Order Syncing: Real-time updates between your marketplace accounts and MyListerHub dashboard.
  • Automation Workflows: Features like Delayed Relaunch, Auto-Pricing Adjustments, Bulk Editing, and Listing Cycles.
  • Shipping Integrations: Tools to generate shipping labels, manage shipping profiles, and fulfill orders via supported providers.
  • Message & Offer Handling: Automation of customer messages, best offers, and post-sale communications.
  • Reporting & Insights: Sales data analysis, profit tracking, and customizable dashboards.
  • Marketplace & Third-Party Integrations: Direct connections with services such as eBay, USPS, ShipStation, and others.

We may add, remove, or modify features from time to time. Significant changes will be communicated in advance via email or within the platform.

Use of certain features may require activation, additional fees, or compliance with third-party terms and limitations.

THIRD-PARTY INTEGRATIONS

MyListerHub allows you to connect your account with various third-party services to extend platform functionality.

Supported Integrations May Include:

  • Marketplaces: eBay and others
  • Shipping Providers: ShipStation, Shippo, ShipCouse, and others
  • SMS Providers: Twilio, Vonage (Nexmo), BrytCall
  • Other APIs: Additional marketplaces, carriers, and tools have been added

Your Responsibilities:

  • You are solely responsible for setting up, maintaining, and securing access to your third-party accounts.
  • You must comply with all terms of service, rate limits, and usage restrictions imposed by each connected service.
  • You are responsible for the content of any data or messages transmitted through those third-party services
  • You are required to obtain proper consent where necessary (e.g., opt-in for SMS messages or email marketing).

MyListerHub’s Role:

  • MyListerHub acts as a technical intermediary that routes data between your account and external services based on your configuration.
  • Credential Handling: We do not store, log, or view your login credentials for third-party services. Authentication tokens are stored securely and encrypted.
  • We are not responsible for the performance, availability, or policy changes of any third-party services.

By connecting any third-party integration, you acknowledge that MyListerHub is not liable for actions taken by or failures of those external platforms.

SMS TERMS

If you provide your phone number and opt in when scheduling a demo, MyListerHub may send automated SMS reminders about your upcoming appointment.

Details:

  • Geographic Limit: Messages are only sent to phone numbers in North America (U.S. and Canada).
  • Consent Required: You must check a consent box when submitting your request to opt in to SMS.
  • Toll-Free SMS: All messages are sent from a dedicated toll-free number, subject to carrier approval.
  • Purpose Limitation: Messages are used exclusively for appointment-related reminders and follow-up. No marketing messages are sent by SMS.

Supported SMS Keywords:

  • CONFIRM – Confirm your scheduled appointment
  • CANCEL – Cancel your appointment
  • RESCHEDULE – Request to change the appointment time
  • STOP – Opt out of SMS communications
  • HELP – Request a call back from a member of our team

EMAIL-SPECIFIC TERMS

By providing your email address, you consent to receiving communications from MyListerHub as outlined below.

Types of Emails We May Send:

  • Transactional Emails: Required emails related to account creation, password resets, subscription renewals, billing notices, and support tickets.
  • Platform Notifications: Product updates, system status alerts, and service-related changes.
  • Demo-Related Emails: Confirmation of scheduled demos, rescheduling links, and onboarding instructions.
  • Promotional Emails (Optional): Updates about new features, offers, or company news — only if you have explicitly opted in.

Managing Email Preferences:

  • Unsubscribe: You may unsubscribe from marketing or promotional emails at any time by clicking the “Unsubscribe” link located at the bottom of each message.
  • Preference Center: If you are a registered platform user, you can manage which emails you receive by logging into your account and adjusting your notification settings.

Please note: Some emails (e.g., password resets or system alerts) are considered essential and cannot be opted out of.

PAYMENT TERMS

  • Subscription Plans All MyListerHub services are offered on a subscription basis, with options for monthly or annual billing.
  • Billing and Payment
    • All subscription fees are prepaid for the selected billing period.
    • Payments are due upon the commencement of the billing cycle. Failure to remit payment may result in suspension or termination of services.
  • Refund Policy
    • Monthly Subscriptions: Fees are non-refundable.
    • Annual Subscriptions: If canceled within 30 days of the initial charge, you may request a partial refund equivalent to 80% of the annual fee.
    • Free Trial – Starter Plan Only: New users subscribing to the Starter Plan are eligible for a one-time, 30-day free trial. Cancellation during the trial period incurs no charges. All refund requests are subject to evaluation and are granted at the sole discretion of MyListerHub.
  • Cancellation and Downgrades
    • You may cancel or downgrade your subscription at any time through your account settings.
    • Cancellations or downgrades will take effect at the end of the current billing cycle.
    • No refunds will be provided for partial use of the service or for unused features.
  • Chargebacks
    • Initiating a chargeback without first contacting MyListerHub to resolve the issue may result in suspension or termination of your account.
    • To avoid service disruptions, please contact our support team to address any billing concerns before initiating a chargeback.

ACCEPTABLE USE

By using our services, you agree to the following acceptable use terms:

  • Compliance with Laws: You will not use our platform for any unlawful purposes or in violation of any applicable laws or regulations.
  • Prohibited Activities: You shall not:
    • Engage in unauthorized access or use of data, systems, or networks.
    • Transmit any viruses, malware, or other harmful code.
    • Use the platform to send unsolicited or unauthorized advertising or spam.
    • Attempt to interfere with the proper functioning of our services.
  • Content Responsibility: You are responsible for all content you upload or transmit through our platform and must ensure it does not infringe upon the rights of others.

Violation of this policy may result in suspension or termination of your access to our services.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in our platform and services, including but not limited to software, design, text, images, and logos, are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these terms.

You agree not to:

  • Reproduce, duplicate, copy, sell, or exploit any portion of our services without express written permission.
  • Reverse engineer, decompile, or disassemble any part of our platform.
  • Use our trademarks or trade dress without prior written consent.

TERMINATION

  • Termination by User You may terminate your account at any time through your account settings. Upon termination, you will lose access to your account and all associated services.
  • Termination by MyListerHub We reserve the right to suspend or terminate your account immediately, without prior notice, if:
    • You breach these Terms of Service or any other agreement with MyListerHub.
    • You fail to pay any amounts due.
    • Your conduct causes harm or liability to other users or to MyListerHub.
  • Effect of Termination
    • Upon termination, your right to use the services will immediately cease.
    • All data associated with your account will be handled in accordance with our Privacy Policy.
    • Termination does not relieve you of any obligations to pay any accrued fees or charges.
  • Survival The provisions of these Terms of Service that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

AGE RESTRICTIONS

MyListerHub is intended for use only by individuals who are 18 years of age or older. By accessing or using our services, you represent and warrant that:

  • You are at least 18 years old;
  • You have the legal capacity to enter into a binding agreement; and
  • You are not barred from using the services under any applicable laws.

We do not knowingly allow individuals under the age of 18 to register for an account or use the platform. If we become aware that a user is under 18, we reserve the right to suspend or terminate their account and delete associated data, consistent with our Privacy Policy and applicable child data protection laws (such as COPPA in the U.S.).

NON-DISCRIMINATION

MyListerHub is committed to providing equal access and a welcoming environment for all users, regardless of background or identity.

We do not discriminate against any user or prospect on the basis of: Race or ethnicity, Color, National origin, Religion or creed, Age, Sex, gender identity, or gender expression, Sexual orientation, Disability or medical condition, Marital status, Veteran status, Any other status protected under applicable law.

Additionally, we will not:

  • Deny access to any feature, service, or subscription tier based on any protected category
  • Charge different prices or rates based on user background
  • Provide different levels of support or quality of service based on discriminatory criteria

We reserve the right to take action, including termination of service, against any user who engages in discrimination, harassment, or hate speech when interacting with our team, platform, or other users.

MODIFICATIONS TO TERMS

We may update or amend these Terms of Service at any time to reflect:

  • Changes in our service offerings
  • Updates to applicable laws or regulations
  • Improvements to security, functionality, or compliance
  • Changes in third-party integration requirements

If we make material changes to these Terms, we will:

  • Notify you via email (if we have your contact on file); and/or
  • Post a prominent notice on our website or user dashboard

We will indicate the "Last Updated" date at the top of the Terms so you know when revisions were made.

Your continued use of the platform after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you should stop using the Services and close your account.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, MyListerHub Inc. (“we,” “our,” or “us”) and our affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be held liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to:

  • Loss of profits, revenue, business opportunities, or data
  • Service interruptions or delays caused by third-party platforms or other integrated services.
  • Errors or inaccuracies in marketplace listings, pricing, shipping, or inventory
  • Unauthorized access to your account due to your failure to secure credentials

This limitation applies regardless of whether such damages arise from:

  • Use or inability to use the platform
  • Platform downtime or outages
  • Integration or third-party system failures
  • Bugs, errors, omissions, or negligence
  • Any other cause of action, whether in contract, tort, strict liability, or otherwise

Maximum Liability Cap

In no event shall our total cumulative liability to you for any claim or series of claims arising out of or related to the use of our services exceed the total amount of fees paid to us by you in the twelve (12) months preceding the event giving rise to the claim.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these terms or our services shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. Both parties agree to waive the right to a jury trial or to participate in a class action.
